I am trying to get a green card for the US. My parents are from east asia and I was born in Canada. I went to University in Maryland from 1992-96 and obtained my dental license. I am licensed in the US and intend to purchase a dental office soon. I will still be keeping my dental office in Canada for at least 1 year once I am able to work in the US. I heard about a investment visa however I am not investing more than $400k but it will employ at least 4 US nationals(ctizens). Can I still use the investment visa or can I get a visa for opening a secondary dental office in the US and still keep my existing office in Canada until I qualify for a green card. Also can anyone recommend a good lawyer. How much should it cost for me and my family(wife and 3 children ). Email me if you wish AT

My case is a bit different.
I have a 485 filed by a company for future employment.
Right now my Priority date became current for my current employer and that labor and I140 are approved.
So can we file multiple 485's with USCIS or do we need to cancel the other 485 to file new 485 with my current employer.

Is there anyway we could include EB immigration relief in the Economic Stumilus Package announced by President Bush by bringing up creative pointers such as more greencards = more small businesses, more greencards = more home buyers, etcetera ? I see a faint chance here. With the urgency to kick start the economy, if we can get something on the bill, it will pass and will become a law fast.

My wife is on a contract jod to another city and now I get this FP notice which is scheduled in the city I reside. is it possible to reschedule it to another location. On the Notice itself there is an option to reschedule is to another time but not to another location

Citizens of other countries -- perceived as "friendly" to the USA -- would be subject to less scrutiny.
The new POE screening procedures use intelligence-based threat assessments. This information will be applied to all persons arriving at a POE, including Americans. If border guards have intelligence that -- let's pretend for a moment -- a university-age male student from Africa might be trying to engage in dangerous activity, then the border guards would be on the lookout for university-age male students from Africa. In contrast, university-age male students from, say, Malaysia, M�xico, Moldova, Monaco, or Myanmar would not be subject to the same scrutiny.

Hmm...so the Name Check hell is back.
Good news for EB2 I/C and all EB3 old filers ! These will save huge number of visas for them. Not many People who have filed in July 07 Visa bulletin fiasco would have FBI name check pending.

I responded to RFEs isuued to me on March 3rd 2009 which they received on March 4th 2009 and since then I also have LUDs almost everyday from March 4th 2009 until March 12th 2009. In my opinion, I don't think it really means anything. They could just be sorting out cases and issuing RFEs to every case that has paperwork missing or insufficient.

During this span my company's attorney has unsuccessfully filed my I140 (twice was rejected at NSC and later TSC - due to 3 year degree and also my job description prior to transfer to US did not showed I have managerial/management function of a department). He refiled again this time with proper documentation and additional support letters from senior exec from my company.
I suspect he has been making mistakes in my filing and my time is running out. I am thinking of using my own money and hire another lawyer to file a fresh I140/485. Is this possible since I have already 2 pending I140; one at NSC under EB-1C and another at TSC under EB-3?
Please reply urgently if anyone has the answer to my question as I am running out of time.

My employer has asked me to take care of our office in India. I am on H1B that will expire in 2011. We have decided for me to spend 2 months in India and one month in US. The plan is to reenter US on H1B since it will still be valid.
I also have a pending 485 and i am going to let my EAD and AP timeout and stick to H1B.
Now, the question is: will this be a problem? Is there a limitation on how long an H1B holder stay outside the US while continuing to maintain status?
I am going to be travelling back to India soon but have already spent more than 5 months in india this year (onver three trips) and am wondering if there will be a problem when i come back in november.
I cant find anything on the net no this.

My H1B was expired on DEC11,2009.My employer applied H1B extension in Oct 2009, i'm still waiting for Approval notice. since my I-94 expired on DEC11,2009. what is my status untill i get my H1b extension? will i be in leagal status until i get the H1 approval?
I have EAD with the same employer but not using.
Is anybody in the same situation?

Since you applied for extension before your current H1 expired, you are allowed to continue to work for 240 days from the date of H1 expiry. Your employer could try and upgrade your pending application to premium processing so you will get to hear from USCIS within 15 days.

I have an h1b stamped in passport that expires in july 2011. However, it is totally unused because i had to leave my company for higher studies in 2009. Now, i am joining the same company again in may 2011 after studies.
1.Is visa extension for 3 years possible in such case..?
2. Will there be any problem because of not using the visa at all till now..?
3. Is there a minimum time limit after joining aftre which only I can apply for extension..?
4. Most important, can i apply for extension even after expiry of visa in july,2011...??

Hi,
I'm trying to schedule my visa stamping date in aug /sept time frame in India. In delhi consulate when I click on Indian resident I see the available dates but when I click on Indian citizen residing in US, I see no availability. I'm not sure which option should I choose. I'm a student working on OPT in US. My OPT will expire on Aug 4th and so I will come to India. I'm not sure which of the two options I have to choose while scheduling an interview :
Resident of India/Bhutan
OR
Indian Citizen residing in United States.
I would really appreciate any help in this matter.

That helps somehow I was under impression that once you invoke AC21 you have to use EAD. I prefer to be on H1 as long as possible till GC come.

yes. AC21 is a provision to allow you to change employers without affecting ur 485. It has nothing to do with work authorization. Your authorization can come from ead or h1 transfer.
