    I am going to take the liberty of putting together an agenda for the conference call, just to make it more productive. I can play scribe for the call.

    The call will be for a maximum of 60 mins, unless someone wants to take it longer than that.

    1. Quick introductions - State your name - GC application stage. - 10 mins
    2. Brainstorming session -- 20 mins
    2. Volunteers who want to be part of the smaller sub-group need to come forward. -- 5 mins
    This is purely to get thoughts/ideas streamlined. Everybody needs to chip in once the action plans are drafted.
    3. Volunteers to exchange contact information. -- 10 mins
    4. Miscellaneous -- 15 mins (if needed)

    Please add more items if you feel they are necessary.

    I will try to scrape all the ideas generated in this thread and will summarize for the call. If anyone wants to post more ideas/comments/suggestions/criticisms, go right ahead and post.

    Not limiting ourselves to "professionals"...

    J. M. Coetzee came to the US from South Africa as a student. He got his Ph.D. in (English) literature from the University of Texas, Austin. Worked as a professor in the US for many years.

    His application for green card was treated almost with contempt! It was rejected.

    He left the US, but occassionally visited top English/Literature departments in the US for brief periods, lecturing and collaborating.

    He was awarded the Nobel prize in literature in 2003. He is now settled in Australia.

    I could go on and on and on ...

    Wow. I'm a fan of Coetzee -- can you tell us more about his green card experience? Why was it denied?

    what should prevail is a matter of perspective. If you are an Indian then skill should prevail, if you are not, then of course it is the other way around

    I think there would be a substantial relief if unused visas are reallocated to oversubscribed countries as in 2003/2004.

    Also the 'side' flow might help immensely.

    As I stated earlier only a US Citizen can petition USCIS for release of information.

    All we can do is speculate.

    Keep dreaming, dreams do sometimes come true, but dream gods prefer GC holders..

    I think he is telling the truth. Otherwise we would have almost 100% attendance for the rally. But it does not seem like. So, i think we "so called higly educated and qualified" need to think about it.

    I heard from a friend who has a brother working in one of the lawyers affiliated with the AILA that USCIS has issued an internal memo to "go slow" on all EB 3 petitions including EB 3 I. That is very confusing to me given that EB3 I is U on the May VB. Has anyone else heard about this? if so can the IV core take measures against this discriminitory move.

    In the words of the person who sent this to me

    I moved to the US on a H1 visa, from India 7 years ago. I have a Bachelors in Engineering and a Management degree as well. I work in the areas of Business Intelligence and Data Warehousing. An area of expertise that helps corporations here in the US become competitive and stay competitive. Among other benefits, my work aids businesses in making informed operational, tactical and strategic decisions and gain competitive advantage.

    With this retrogression, It is going be several years before USCIS will even get to my file to adjudicate. While I understand a green card is not my right, I think I have worked towards it for a long time now. I am in this country legally, paying taxes, contributing to this economy, spending my earnings in this country like any other law abiding American citizen.

    I have legally asked this country and USCIS for Permanent Residency (PR). My request for PR is not based on the premise that my parents/relatives live here and are citizens in this country. I am not even asking for Permanent Residency because of the country I come from. I am asking for Permanent Residency based entirely on my educational qualifications, professional expertise and the demonstrated contributions I have made to businesses and the American way of Life.

    I have also been accepted as an Instructor at a reputed University in California where I will be teaching in my area of expertise. This clearly helps the American society and Industry.

    When I moved to the US, I believed America is all about meritocracy. Work hard, prove your worth and you get what you truly deserve. I feel six years is enough time to prove your worth to get a Permanent Residency.
    My tax returns, my legal Status documents, my contributions to this economy etc will prove it. What is really disconcerting is the fact that, now I have to continue to wait for I don't know how many more years for USCIS to even look at my credentials, let alone give me an up or down decision. Mind you this wait is not because of any delays attributable to me.
    Is this fair ?

    If you think you don't need me, at least tell me, in a reasonable period of time. Please do not make me wait indefinitely.

    As many are aware, there was a huge rush to buy and sell pre-approved labors during July-August 2007, when all the priority dates were suddenly made current. Tens of thousands of labors were sold by fraudulent consulting companies to many questionable GC seekers, who hadn�t even started the process till then.

    It is those substituted labors which are clogging the pipelines now. Just think, last month EB3-I stood at November 2001. Now it is completely unavailable. It can�t be possibly because so many pending labors with such old priority dates suddenly got cleared this month, and beneficiary of these labors filed 140+485 together. I seriously doubt that a candidate whose labor is pending since such a long time is even keeping that GC process alive. In all likelihood he/she must have moved on in life.

    There is only one explanation. These labors were already pre-approved. It is the attached I-140 on these labors that are getting approved rapidly. And the subsequent I-485 petitions on these applications are depleting the visa numbers.

    The reason of this post is not to start an argument about the ethics of labor substitution. It is just a FYI post to explain the seemingly inexplicable. The chickens are coming home to roost.


    Yes true. A significant chunk of the old PDs now are cases of substituted labor.
    Labor substitution was acting like a time machine to go back in time and apply for GC.
    People paid as high as 10K to 12K for old labor.

    Chanduv23 First - let me say I respect your outstanding and active contribution on this forum very much. Having said that, I'd say, you both conveniently missed the point in my post.
    I am not arguing about who is ahead in the line to get the non-existent cake - please read my post once again and point it out to me where I said anything in such regard..

    Frustration comes from the point that all the discussions take tone that all IV efforts are to help EB2 category alone. It is becoming frustrating for EB3s to keep reading posts and participating in actions when everyone keeps portraying IV effort as EB2 only effort.

    I'd request you both to please read my post again.
    All I have said is that message need to be made stronger that IV effort is for all EB community.

    By responding with who's ahead in line type of comment you both are just ignoring the situation that already exists as of today on this forum wrt EB categories. I'd venture to say that if at all you're making that feel of eb3 left out even worse than it already it.

    Apologize if I have offended anyone and will gladly take that red dot for speaking out my mind.

    As far as the lawsuit is concerned, just like all the other IV efforts, I'd gladly participate in it.

    Another possibility should also be investigated and that is re. selective enforcement of zeigler memo by some DOLs.

    Thanks for sharing the experience, as some others have posted, the Visa numbers for this month have all finished for EB2, so you may need to wait till next month i guess....

    I've seen dozens of people exploiting sub-labor and got their gc's. There are thousand's of them jumped the queue for last time in July '07. I do agree with the person who started this thread.

    There isn't anything we can do about it now. Let's concentrate on what we can do.

    I will give you a couple of reasons, why I am not supporting this idea, at the same time I won't discourage you from doing it:

    Last year when CIR was being discussed in Senate, anti-immigrants sent thousands of bricks to Senator's offices. Bricks build walls, their message was clear, focus on border security first. This was a -ve campaign. It was popular in the right wing media but since CIR passed in Senate. I am presuming this campaign didn't work. The reason it failed was because the idea was to grab headlines but no thought on what after that. No strategy. Lets correlate this with flowers. An officer at USCIS will get these or maybe a dozen people. They will feel good. End of story. They don't have the ability to change the USCIS policy or the July bulletin, which is IV's aim. So basically sending flower is a gushy gesture and may sound fancy but USCIS doesn't work on emotion. If it did, why would they loose thousands of visas each year even though there is rampant backlog and retrogression?

    Some members say well, flowers will attract media attention and hence help our cause. Well, unless Paris Hilton is sending those flowers you won't get much media's attention. Indirect, subtle and passive communication doesn't work in America. That is a cultural issue that these members need to come to grips with fast.

    Our goal is to make USCIS accept July applications for AOS for GC. Since USCIS won't do that whats the best way to do it, well to exert external pressure. How is that done. Contact Media, Senators, Congress members and the Judicial system.

    Too much babbling on my part, now, I am going to write a journalist requesting more media coverage on our issue.

    We are not sending pen, paper and cal to caluclate the accurate VB. And one more thing we are not fighting for it, just we are telling how badly we effected with the "flip flop" game of USCIS.

    Pls see the first page for plan of action..we are gonna send the e-mails to reporters...i guess this is gonna big hit.

    When you are writing to journalist mention about the JULY 10TH FLOWER DAY!! I am sure she/he will ask couple of questions abt it.

    Finally got the email today, Aug 13, 2009, from USCIS indicating that the card production has been ordered for me. No word yet about my wife's GC. Case still pending.

    Relevant data for me:

    India, EB2 - Priority date April 14, 2004
    Texas Service Center.

    Short of divulging my social security number, I will be happy to answer any and all questions about my journey so far.

    Congratulations to you !!! The PD for EB2 India for Aug 2009 is "01OCT03". I am wondering how they processed your application.

    Are you sure your PD is Apr 2004 , category EB2 and chargeability is India ?
    Your PD will be current for the month of September.
