I agree that this topic should be researched, and we should have all possible statistics/data on it.
I tried to locate on immigration.com, but I couldn't find the information. I will continue to look.
If Mr Chandu, or Mr Unitednations could quickly locate the links, and post them here, I (we) would be greatful.

Guys, please stop pointing each other on past issues. Please work together to fix the broken system. Past is past. When you get angry, I know it jumps you to hate all negative objects. Nothing we can get out of it. Please. Lets be united to fix things. Blaming will not fix anything instead it pulls legs of each other and finally set backs.

Hello Everybody,
This is my story,
1 - Came to US on B2 (visit visa) in October, 1999. My legal stay way valid till April, 2000
2- Found an employer and in March, 2000 filed for H1B/extension of stay. Lawyer at the time told me that since we filed H1 i don't need to file any other extension of stay
3- August, 2000 received approval notice of my H1 but approval notice mentioned start date of October, 2000 rather than March, 2000 as requested in the petition and approval notice did not have the I-94 card attached with it meaning they did not change my status. Appealed the decision and got some feedback from USCIS that they will look into this. Started working for the company in October, 2000. In January, 2001 Company received another notification from USCIS but I was never provided the copy so not sure what was the decision and was told all is fine but never provided the final approval notice. When i checked case status back in January 2001 it said case approved and approval notice sent. However when I check online case status now I see following,
Application Type: I129, PETITION FOR A NONIMMIGRANT WORKER
Current Status: Cable sent to American Consulate or port of entry notifying them of approval.
On September 7, 2001, the appropriate American Consulate or port of entry was notified of the approval of this case. Please contact them directly if you need more information.
4 - In 2002 transferred my H1 to new company and got the approval with new I-94 card without any issues.
5- In 2004 transferred my H1 to another company without any issues and I�m with that company since then. They filed my labor, I-140 which has been approved and now ready to file I-485. As per this $20 drive, I tried to contribute thru my Visa Card & it was "repeatedly" prompting card# enter is invalid...I checked/ensured expire date/secure code & info which I entered is correct but repeatedlly it was prompting same message...Anybody from IV can help whats wrong with the web page?

Currently, the workers have to apply for green cards through their employers, often a lengthy and cumbersome process. They can't switch jobs easily and sometimes have to reapply for a visa even if they move jobs within the same company. They have to leave the country every few years before they can reapply for a visa.

How many of you guys are taking infopass appointments? When you go are you going alone or both applicants (meaning spouses too)...
I'd go to the boston office....and if anyone goes there it'd be nice to know their experience...if it is of no use...I won't make that trip
RD and ND will be a question mark always....but my congressman to whom I had written a pathetic letter came back to me saying my case is in final stages and checks are done waiting for visa number (and I was definitely outside both RD and ND in August last year)...Dunno who to trust .....and then in Oct/Nov I got an RFE so what is the meaning of that....
Problem in contacting the congressman's office right now is that everyone is busy with the healthcare reform and immigration they don't care a rat's add about...

I have been on IV and actively participated in a lot of campaigns and events and interacted with a lot of people from different walks of life, different nationalities, different situations etc ... WHat I have noticed is, everyone has their own opinion and stay entitled to their opinion. Everyone wants to be judgemental through their opinion.
Now, lets all for a moment - step out of our "legal immigrant" shoes and step into the shoes of someone who has to decide what to do? As a decision maker, what will you do? Everyone has their own opinion to which they are entitled and thats whats happening.
Now, ocne again - step out of your legal immigrant shoes, and say, for some reason, you lost status and are deportable - what will be your opinion? Would you say "Shakle me and put me in detention center?"
If you are in poverty and and have no food for 2 days, you may go grab a bread from a store and run to a safe place and eat it - will you talk all these rules about shop lifting .....
If you catch a hungry child shoplifting to eat a bread will you PUNISH him? Ir will you try to do someting to make things better for him?
All you have to do is to come out of "the hate and hard" thinking and try to look at things in "rational and meaningful way"
Hate no one for what they are or how they are. Try to see if you can help. Just help.
I have been living in US for close to 10 years now and though I am proud of fellow Indian community and their achievements, I have also noticed how the community is divided and oponionated. Forming so many sub groups, promoting caste feelings, fighting each other, trying to piut down other fellow community members, lack of unity and what not ....
If everyone in this world want to be considerate and help - then there will certainly be a day when we can see a world without poverty, wars and all the issues we are having today.

What I and the majority of people in this forum do is their best to make sure they dont loose their status. If on the other hand it happens I would return to India and consider all options to reverse it. What I and majority of people here wouldnt do is stay here illegally. Loosing you status is not a crime for which you are shackled and put in a detention center. A repeated pattern of violating the law is.

This analogy does not apply to anyone on this forum as "Legal immigrants" plan for contingencies. Even if it happens I would ask for food as a favor from some one rather than break into their house and demand it as a right!

We are talking about a 35 year old woman with a repeated pattern of ignoring the law, not about a hungry child. This is a completely false comparision.

So please take a crack at how it works. Above posting is right from the horses mouth. As I challenged people if they think DOS/USCIS is breaking the law by going vertical instead of horizontal then they should contact them or sue them. However, no one has been willing to do this.
In my opinion by 'Using the unused EB2 visa for EB3 ROW instead of EB2 India', USCIS is following the law as congress pased it...The law may be not fair but that is a different issue...If you want to change the law you have to get that done from the congress...suing USCIS would get you nowhere....
In fact USCIS could do anything they want...They can let it flow vertically or horizontally...And they would have a good enough case in courts...
