This is the sad reality. A lot of people applied using sub labor during the June and July fiasco. A lot of people made it through the July 15th deadline by atleast filing a 140 through sub labor.
Now USCIS is processing all these 140s and as they have old dates, they are becoming approvable.
As long as there are visas with old dates approvable - USICS will exhaust them. As long as USCIS exhausts old visas, DOS need not move the dates forward.

I would suggest two things:
1) Fire her and let her know the reason. If possible show her the video, that will definitely scare and embarrass her. You cannot undo what she did to your child but that will teach her a lesson and hopefully prevent her from doing that to another child.
2) I would highly recommend sending your child to a reputed daycare. Ofcourse your child will not get personal attention like home, but that ensures the safety of the child. There are other benefits of a daycare like - social interactions, personality development, fixed routines, curriculums, and above all they are trained professionals.
Give it a thought.

Sorry for this non-immigration related post. We have this sudden, tragic situation that I wanted all of your advice on. Thank you for your time in reading this long post.
We had hired an Indian nanny in NJ who, we learnt after hiring her, is here on a tourist visa. We were paying her $350 per week cash, which is the standard rate around here for nannies (incl. citizens and people on GC). We had liked her when we met her in response to an ad on Sulekha, and we thought an Indian nanny would be good for our first child. She has been with us for about 3 months, and we were intermittently not getting a good feeling with her for some reason. We finally bought a small security camera and installed it yesterday. On the very first day with the camera, we came home and saw the recorded video to find that she is violently hitting the baby on two separate occasions. Needless to say, it has shocked, angered and extremely saddened us. I showed the video to a couple of friends and even they say it is unbearable to watch. This was just the first day of recording and it pains us tremendously to think what all may have happened previously.
She is of course not going to stay with the baby alone anymore, but I want to know what legal options I have to penalize her to the fullest extent, so that she does not do this to anybody else�s small babies. She it seems had come here last year and taken care of someone else�s baby in Hoboken, and I can imagine that their baby also went through this. (This woman and her husband are a ~ 35 year old couple, who have a multiple entry ten year tourist visa; both come here for 6 months every year and work odd jobs like this. They apparently got a (unsponsored) tourist visa after showing a lot of landed property in India).
I specifically want to know if I will have potential problems if I go to law enforcement about this- regarding have employed her (both of us are on H1B visas). I know we have made mistakes and should have done better due diligence in this, and there cannot be any more punishment for us than seeing our 8 month old � who cannot tell us about it when we come home- being beaten on the tapes. We saw this yesterday and have not told her yet. We want to weigh all options before we proceed, but from today onwards one of us is home all the time till Friday. Any advice or opinion is sincerely appreciated. Thanks for reading this long post. And, to all who are thinking of nannies or have one, please learn from our mistakes and closely monitor your child�s safety every day.

Its pity that MOST CRITICAL issue we are facing at present - AC21 Denial issue, is having only 77 mails but everyone is jumping gossipping. Come out of this and show a unity to real problems.
Grow up and don't escape from real problems. Its our problem and we need to fight to resolve it.

.... Our 5 PM meeting was with a Congressman himself and had a Core team member, myself and another member who was later offered an unpaid Internship by a lobbying firm. Just when we were wondering why the position would be unpaid we were told that the reason for being unpaid was because the green card process for the member accepting the position would be reset since it would not fall under same or similar category which made all of us crack up.
Was this intern an IV member or was this intern a member of the staff - and is the lobby firm that hired him working on fixing immigration issues?
Our closing meeting went on until 11 after which each one of us took our Action items and next steps to take back to our districts. Everyone we met over the past couple of days told us to keep up the work we have been doing for the past few years. Good work and great follow through always leads to good results.

I decided to move to india now. I have I140 cleared and having a permanent job. But enough is enough!
I started looking openings at india 2 weeks ago and most probably will get a offer from a US financial giant having IT shop at bangalore.
I think this is right decision at this time.
Any suggestions/feedback guys?

You seem to have gotten a stable job which probably means you are better than most of the people who are working as contractors. But what matters is being on Visa, are you able to enjoy your life here? Will getting a GC help you have a better life or will you continue to lead the same life?
I think if you believe getting a GC will help you lead a better life you should stay here - since your i140 is cleared its another 4-5 yrs wait max. On the other hand if your job here is unstable and you think you will have a better life back home, then you should move. Bangalore is a great city as long as you have a comfortable job and good pay.

Hi,
My company is located in CA state. Currenlty i am working in Client place i.e in Oregon state.
My labor and I140 got approved in my old residence CA address.Now i applied I485 for me and my wife by showing Oregon state address thorugh my same employer which is located in CA state.
Pls clarify, wheather this new address will make any impact on my I485 process(approval).Becoz some ppl in forums are mentioning that, if we don't have LCA for new state then I485 maybe denied becoz of "out of status".
pls help in this regard.:)

If there is a legitimate reason to send emails to you from IV, why should it bounce? Also why are you scared to provide an email address to IV (it can be a yahoo, gmail, hotmail address too).

Thanks Ragz4u. We shud try and publish info like this on the website in an "Recent Updates/Activity" section. That section will give not only what IV is doing currently but also what the impact is. Now i dont know if that will have adverse consequences, but if it wont then we shud publish more such info on the site. This will convince the fence sitters to contribute and participate more actively. We have the forums on the extreme right, above or below that we shud have a "Live/Recent Updates/Activity" or a link updated as frequently as possible. There was a saying that "IV never sleeps". I think it is time that the people visiting IV and it's forums know that and know what all is going on.
Does that sound like a good idea, or is it going to have adverse effects?

This is a very good suggestion that should be seriously looked at...in order to get broad based support, we could also think about adding ability to file for I-485 when the dates are not current....this way the pool of people likely to be impacted will be large enough to reach a critical mass...

Following up on my previous post. Here is the format for the ad and the affidavit. We went to the DC embassy to get the name changed and they have next day (business days only) passport-by-mail service. I don't think they have same day service.
Actual correct name: <corr_first_name> <corr_last_name>

Name in US docs (Visa, SSN, Drivers Lic.):
<first_name_us> FNU _OR_ <first_name_us> <first_name_us>
Format of the ad we placed in Indian newspaper (TOI) and local US newspaper:

First of all, It is funny that the guy who knowingly broke the law want help of law when he is victim. Now all of us know why laws are made in first place and why everyone should follow it.
Secondly, Beating the dead horse again, Thunderbolt should go to cops and give evidence of child abuse asap.
In terms of risking the case of hiring illegal for a job by going to the cops in my mind is a non issue. Because, he is exposed to that risk with or without going to cops himself. What if Nanny gets caught working illegal in some other home and she gives all names she worked for including thunderbolt. He has done a mistake and he should hire best attorney to plead that case if it ever comes up either by him reporting child abuse or some other way.

Can you tell exact wording you used in the letter of completion. I would assume that you need to have following statement in the letter.
"xxxxx has completed all the degree requirements"
instead of just having "would be graduating"
Do you happen to know anyone who has been granted visa with this document saying that the student has completed all the degree requirements? Also, if I get another document from my University can I add it to the file I have already submitted to immigration?

I think with in this short time duration, i am going to proceed as such with my wife's name problem, and once the 485 has been filed, will go ahead and try to get a name change done for the passport from the indian embassy. I was told by one of the members on the forums, that you need the following things:-
1. Advertisement in a National Indian News Paper.
2. Advertisement in a USA Local News Paper.
3. An affidavit from you, but if you are married and have the original marriage certificate, then it should take care of the affidavit.
I think the costs to get it done is $70. If some one can suggest some other options that will be great.

Does one need to be on an F1 (students) visa to get an assistantship?? Can one work only on university campus while doing their assistantship?? If not where is one eligible to work on assistantship & what type of jobs are available?? My wife is planning to do her CPA on an H4 visa, can she work on assistantship while pursuing it??�Please respond.
I am sorry...I do not have too much info abt the H4 visas...Actually I am not sure whether she can do an assistantship on H4 only because it is not a visa on which you can get paid any compensation for work...Isnt the institute where she is doing her CPA sponsoring her F1??
