I know I will get red dots for this since you are super moderator, but again IV is a free speech based org, I am a Masters (advanced education) from a very prestigious US university with full scholarship with 4.0 GPA and in EB3 employment category. Eduation and EB catergory are two different things, one would think that would be clear by now.
it goes deeper than that. first let me point out that this is philosophical- you argument is not about law, it's about a point of view.
so if i ask you why EB2 filers should spend extra years getting educated and never getting this all important magic "PD" and then get in line behind someone who got a job the day they entered the country- and got a PD soon enough- what would you say?
ask me. it took me 11 years to get a PD. why? for 7 of those years i was getting my advanced education. so why should i suffer behind the 3 year Indian degree person (against my 7 years there as well) who came in 5 years after me and filed right away?
there are reasons why the EB priorities were set up. by simply extending your logic EB1 should also wait for a turn and not have priority. what's good for the goose....
having said that, it is absolutely insane to ask people to wait indefinitely and we must do something about it.
today the EB3 folks (and I have nothing against them, their waits are insane- and it's absolutely not right) are porting to EB2 with those bachelors degrees and 5 years experience. and just because they could APPLY for a GC earlier and all their years get counted in the PD, they keep lining up ahead of me. why do all my years count for NOTHING?
please spare us "fortunate" EB2s a thought too. think of when in life our careers are finally freed from waiting for a GC.
and now please concentrate on ways to end retrogression and stop the EB2 vs EB3 crap. we all have our problems.

I'm not sure if I'm eligible to apply for Master's quota. I'm done with all my degree requirements and I've scheduled my thesis defence on MAy 20th. Is it still possible that I can apply in Master's quota. I've a letter from my schools which states that I'm done with all my degree requirements and I'll be finishing thesis on May 20th. Is this letter enough to apply for MAsters??

You can call this also as jealous. There are too many people from the other countries will have to wait because not having people to mass migrate to US. Arguments can be made in way. So be sympathetic. Your issue may not an issue for me. Do not call it as jealous
What they are saying not jealous. According INA priority date in case substitution is the day I-140 is applied. Somehow the original labor date was assigned as priority date . This might be an error but is causing problems and Inconvenience and injustice to some innocent people. You can call it as jealousy. That is alright but they have an issue which they need to fight. However small number may be it can benefit these guys.
If you do not support them that is OK. The moment you start using the word jealous, anti-immigrant etc. it stops the discussion.

I am going to file my h1 application tomorrow under the master's qouta. I know its nearly impossible that my petition would be approved but I have no other choice. I just have one question:
1. Should I go for a premium processing?

I can understand your frustration after getting Oct bulletin. BTW, you have current PD for Sep 2008, so why don't you consider suing to get GC this month. :D :D

Friends,
What I need to do now? My I-94 has wrong expiration date (I entered in US on 03/07/2007 and I got I-94 with expiration date as 01/10/2007). My attorney told me that it can be explained later. So, I've already file my 485 with a bad I-94.
Please let me know if anything can be done or still I can do something to correct this issue.

I say again, go to the cops. I understand you did wrong when you hired an illegal immigrant, paid her in cash, etc. It shows your wrong intentions. But in all honesty, that argument is mute, you are not responsible to verify someone's immigration status, I bet you can argue that with an attorney. You are dealing with a much more serious issue here. I pity the guys who suggest not to complain. Either they don�t know what their son means to them, or they have simply messed up their life prioritizing GC over every thing else.
I don't support hiring an illegal nanny or getting someone from India. But what is done is past. Bigger crime here is someone hit your son. If I were you I would have made her life hell, I would have gone till any extent to make her realize what she did. I give a damn about the GC. My first priority is my child. I completed my MS in Computer Science from US around 6 years back, was on OPT for a year & thereafter moved out of US and came back to my home town. Have been working here for 6 years now as in the software field & have now applied for H1B under masters Quota. Was wondering if I am eligible to apply under this quota as I am neither a fresh graduate nor have any status in the US. Also, my lawyer has only filled out the I-129 form. Is there any special form that needs to be filled out to be considered for Master's quota?

Somewhat very good news. It turns out the total FY 2008 H-1B cap cases which they received are not 150,000 nor 133,000. The total number is 119,193. Accordingly the odds of winning in the lottery will be only 2:1.
For U.S. advanced or higher degree cases, they only received 12,989 and the H-1B for these people is still wide open and they can file the petition now.

I have a problem where my "Given Name" is entered as "<first name> <last name>" in my passport (India). The "Surname" is left blank. I have been in the US for 7 years now and it has never been a problem so far. I usually enter the "<last name>" in the last name column on all documents. I wonder if this will cause problems during the I485 name check stage. Any one here who can throw some light on this issue?
I realize that the question is a little weird, I appreciate any response.

Thank you to all members here and core members. I have been watching this thread since June 30. I can't believe this is actually happening.
I was the one who DID NOT send any flowers because I was simply scared.
I was the one who DID NOT contribute any donation to IV.
I was the one who wouldn't do rally, simply I did not think it's gonna work.
Now, I am very happy. At the same time, I shame myself.
Once again, I bow to all members who actually did something & contributed something to this community and entire legal immigrants. I will remember this day even when I get a citizenship in the future.
Finally, I like to make a donation to this community. However, let me finish my I-485 filing NOW! lol gotta send this to my laywer tomorrow morning...
