When we use the recent I94 (from the H1), do we need to say "were you inspected by an immigration officer?" as "yes"?
The start date for this should be the date of entry at the airport or the start date on the recent I94?
First question answer is "Yes" though you got new H1/H4 or any other visa extension papers the I-94 will be same which intially inspected by an immigration officer. That's why answer is Yes.
The start date is the time when you enter the country.

hi everyone
I m an MBA(major:general mba)student in a university in texas. I have an bachelors of engineeing (electrical & electronics)from india. I have found an desi employer who is ready to train me in SAP (FICO)functional and than place me on projects to diffeent companies. Since i m graduating in august 2008 ,At first i have to work for him on OPT and than in apil 2009 my employer will sponcer my h1 visa.
Now my question is....
1) can i work in SAP FICO functional , when i m on my opt?(opt means i have to work in a job directly related to my major field of study and i guess SAP is not related to my field major field of study)
2)will i have problems getting a h1b visa? (since General MBA and SAP are completely different fields )
Any comments or suggestions will be appreciated.

It is possible. There is a relatively unknown technique called TT (abbreviation for Time Travel) which is also relatively related to relativity. When applied correctly, it is more effective than PD recapturing and labor substitution. That's how I got my green. My daughter is 2.5 years old and is on H4. She is receiving some modelling offers for commercials and photo prints. I understand since she is on H4 she cannot work. But can I apply for her EAD and work SSN by which she can work on these assignments?

Unfortunately, there is not going to be a hard consensus and a good satisfying answer until USCIS comes out and fixes the law. The problem comes from inconsistent USCIS memoranda as to whether an employer who moonlights on EAD has "left" his employer.
AILA has recognized this inconsistency and has provided us, immigration attorneys, with guidance on arguing why the inconsistency should be construed to mean that moonlighting on EAD while preserving H-1B is ok; however, nobody can guarantee that the USCIS will agree with these arguments 100% of the time.

most employers dont file EAD or AP - (if the beneficiary is on H1)

I would like to get your opinion on current situation.
Education: MS(Ind Engg), 5+ yrs exp.
I have priority date of Oct -2007(applied for labor under EB3). Got approved I-140 in Feb 2008( EB3 category). I got promoted to next level so requested to apply for labor once again in EB2 category in Feb 2009 and got approved labor in Feb 2010.
Is there a provision to amend labor and include previously approved I-140? Or Do I have to apply I-140 once again? and my priority date would be Feb 2009?

No problem, because of the work NSC are transferring some cases to Texas. In fact, Texas center is issuing EAD and AP so fast. so your wife will get her EAD very soon.

I would like to know that can I apply for EAD extension for me and my wife since my I-140 application was denined last year. We have already appeal for decision on I-140 application to AAO office. I am intend to get my wife's EAD extended by year end.

If she stays put in US , Effective Oct1st, her status will be H1.
If she goes out of the country and enters back using her H4 stamping, she will be on H4.
If she intends to work, she will have to either apply for Change of Status from H4 to H1 or needs to go for H1 stamping and enter US using that stamp.

Lawyer says he sent the employer verification letter with his signature instead of employers bec employer has given him authorization to do so. can anyone do like this. does this pose a problem for my I485 approval. 1) Do I need to take Affidavit of Support docs(form I 864), my 485 is employment based and not family based(I am the primary applicant)
2)Do I need to take Original I 140 and Original Labor approved doc
also please let me now if some one have been to such interviews and if there are any suggestion?

My employer did not allow us to file EAD and AP for employees. Only for spouse) and I was wondering if I can file myself. But I don't think we can do it without a receipt notice.
As far as new fee structure is concerned, we'll be better off paying the new fee compared to the old fee and attorney fee combined.

Today, I received an email from USCIS that my EAD application got approved. My receipt date is on the 3rd week of May of 2007. What I don't understand is that the current processing time at NSC for I-765(EAD) for pending I-485 is March 26th, 2007.....
We have the exact same situation down to the receipt date :eek: I was so shocked I almost fell off my chair when I got my email. A completely unexpected surprise but a good surprise, nevertheless.

I got a card production email on 6/25, got the 485 approval notice in the mail on 6/27 but haven't received the card yet as of today, 7/1. Anyone seen this sort of long delay in getting the card?

Call USCIS and verify your address. Have you moved receently - sometimes your AR11 change of address may not have been recorded on your case.
I am sure, you will get it anytime.
