    Hi,

    Is there any way we can check our labor processing status as it is a genral fact that no employer would prefer to give his employee to access his status and at the same time they would not let employee to call attorney directly.So in this kind of scenario I was just wondering is there anyway we can track the status.

    I tried to find the thread posted by PAPPU on ability to pay. Could some one help me with this?

    PAPPU:long time back I had posted something on ability to pay. look into the archives. Are you currently employed with this company?what is your current wage? what is the size of the company? how long has the company been in business? what has been the income in the past few years? how much cash do they have in bank? Do they have any external funding? how well do you know the owner? How many people have filed for GC in your company?

    Ability to pay is a complicated issue to be answered without knowing all the details. Remember all the data needs to be fully legal (your small time employer should not be saving taxes by using tactics that help him financially but are not right thing to do) and correct and your employer should be willing to help you with all the information. This issue is not difficult to solve. With the help of a good lawyer who knows about the intricacies of ability to pay and takes active interest in your case and a good experienced CPA you can easily overcome it.

    Hi all

    My I-485 is pending(EB-3,India)since 2007. I changed employer & successfully ported PD on new I-140 approval in EB-2 category. My PD is in Oct 2006 & I expect that to become current in the coming few months.

    Now, I need to do Interfiling to link my pending I-485 to my new I-140.

    (1) What all documents/wordings are required for interfiling? Can someone pls provide a checklist?

    (2) Who should do Interfiling- Myself or "Attorney of File" on my original I-485 or my current attorney (who did my new I-140)?

    (3) Can I send my Interfiling request to USCIS even before my PD becomes current?

    Today my lawyer sent me my receipt numbers for 485, EAD and AP. when I enter my AP receipt number to check online status I see the following...

    Application Type: OS155A, IMMIGRANT VISA AND ALIEN REGISTRATION

    Current Status: Card production ordered.

    On August 30, 2007, we ordered production of your new card. Please allow 30 days for your card to be mailed to you. If we need something from you we will contact you.     Anyone know what this means... It doesn't say I-131 in application type..

    Second disturbing thing I noticed when I entered my 485 number...

    Application Type: I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS

    Current Status: Fingerprint fee rejected and notice mailed; case in suspense.

    On August 23, 2007, we rejected your fingerprint fee and mailed you instructions for how to submit the necessary payment. This case is now in suspense. Please submit your payment with our notice as soon as possible after you receive our notice so we may resume processing of this case.

    My lawyer says the checks have been cashed and we have proof of this.. She says it can be a typo..
    Most weird part is for my EAD it says card has been ordered.. but I haven't even done finger prints and my 485 is in suspense..

    Anyone any idea whats happening.. should I be worried about OS155A and 485 things..

Your best option would be to get in touch with the designated Application Support Center to see if they can either notify the USCIS Service center of the error or have your daughter come in right away for fingerprinting. ASC phone numbers are generally not made public, but in many locations, ASC staff has provided local immigration attorneys with a phone number to use for urgent or unusual situations such as yours.
    If you don't have an attorney who can call the ASC for you, you might consider just going to the ASC in person with your daughter to explain the situation and ask for their assistance.

    Gurus,

    My H1B extension is pending with the VSC. I want to upgrade my H1B extension to a premium process by paying 1000 USD.

    Now, my question is - Can I do it myself thru efile or regular way using form I-907? Or should it be done only thru the employer or attorney?

    I am asking this because my attorney is charging a ridiculous attorney fees of 250 USD on top of 1000 USD for upgrading my case to a premium!

    As long as previous employer not revoked/Cancel your i-140 you are safe. You can port your priority date.

    But i don't see any body who ported PD even if prior employer cancel or revoke.

    Hi Guys,

    I had recently changed jobs and my new employers attorney were going to file AC21. But my company was acquired by another large corporation and the attorneys have changed. The merger company's attorneys are Pappas and Lenzo. Does anyone have experience with this firm , in terms of h1 filing, I-140/I-485 related cases and other GC stuff like AC21, etc.

    Any input would be greatly appreciated.
