My company filed my 7th year H1 extension and my wife's H4 petition at the same time in Dec 2006. USCIS online case status shows received and in process for both H1 and H4.

Recently, we upgraded to premium processing. However, only the H1 case status now shows as being done under premium processing. Does that mean that only my H1 will be premium processed and not H4 even though they both were filed together. Is this normal. I am hoping both H1 and H4 will be premium processed. I know that USCIS adjudicates H4 also in premium processing for such cases as a courtesy. Just wanted to know if anyone has been under similar situation before and got only their H1 approved in premium and not H4....The whole purpose of me upgrading to PP was to get H4 approved before the H1 quota begins in April as our H1/H4 were expiring this summer and my wife's employer is filing a H1 COS petition for her in PP under the 2008 H1 quota....Didn't want to take any chance of her H1 COS getting approved without a I-94 because of her current H4 expiring in summer.

it is nothing but an employer letter in which you need to specify your designation and your continuation of your employment with that company. I sent the same letter for H4 stamping to my spouse.

Hi,

I am really confused about my current status.

I am currently on Opt Extension, which expires on June 1st 2010.
When i filed for H1b visa last year April 2009.

I got my petition approved, but my change of status was denied.
The reason was stated as :
The status previously accorded the worker had expired before this petition was filed. Therefore, the worker si not eligible for change of status.

Now, I am still in US. Is my status illegal?

Extension = from the time requested = for example 4/1/2008 to...no more than 3 years. 3 years is the max time requested. So, if you company requests from 4/1/2008, it should state until 4/1/2011.

I think you need to have a consultation with an immigration lawyer, if you want a legal opinion from someone other than your current lawyer. There isn't really enough information in your question to give an answer. Without knowing why the L-1A petition was denied, it's very hard to suggest a strategy. If there was an RFE issued before the denial, you should be able to see what CIS was concerned about.

Are you eligible for E status? I don't know your nationality, so can't answer this myself.

I am on an H-1B visa I had a confusion regarding my wife's case. She is on H4 visa and her H4 visa was extended to September, 2009 when I changed my employer (XXX) last year. However, her passport carries H4 visa which expires in Oct. 2007 (this was through my previous employer, YYY). Both our I-485 are pending and we both received our EAD last month. She wants to use her EAD to work in future.

A twist is that a consultant had filed for her H-1B this April and we don't know if her H-1B came through or not. He is not telling us. We just don't want to deal with that scumbag. Can we just ignore him and forget about it? Since her I-485 is pending she has a lawful status (Pending AOS), right? Please let me know what you think.

FYI...Anybody who has an appointment for a Visa stamping on Oct 1st at the U.S Consulate in Chennai, India, please contact the VFS office (91-44-4231-6767) to find out your new date of appointment (which the Consulate says, will be in the same week), if they have not intimated you by email already.
