It is possible to "interfile" in this situation, (See AFM Sec. 23.2(l) Transferring an Adjustment of Status Application from One Underlying Eligibility Basis to Another).
However, I do not think you can successfully interfile until your wife's 2010 PD is current. ( See AFM Sec. 23.2(l)(2)(L) The Priority Date must Be Current for the Basis to Which the Applicant Wishes to Convert).

I have H1b Stamped in Jan (Approved in 2007 valid till 1 Oct 2010). My Petioner is well run lawful consultant company (have filed 100+ H1bs since 2001) and he wants me to come to US. My Petioner has in-house as well Client side Projects.
I am having around 8 years of IT experience and Graduate degree in Computer Science. I have worked in past as full time employee with US' No.1 IT Manufacturer in India & have travelled to US twice on Business Visa, I am currently working with a US Bank's Offshore Technology centre in India.
My question is "Is it safe to travel in First week of March 2010 to USA with my H1b stamped in January 2008. In that case What documents I should be carrying along with I-797 Notice of Approval of I-129 Petition.

You should ask both law firms to send you your 485 paperwork, assuming you are listed as the client. they might not send you any I-140 documents, since this was the employer's filing, but the 485 documents should give you what you need. You should write to CIS saying that you are no longer represented by attorneys and ask them to send all documents directly to you. Unfortunately, CIS can be very slow in acknowledging these requests, so it is likely that correpondence will continue to go to one or both attorneys.

I would suggest googling for the Indian consulate in your jurisdiction. Although most indian consul websites are confusing and really difficult, so good luck.
btw, if your daughter was born in India, but she is here with you, how did she enter USA without a passport.

Can the core group let us know what are they targeting right now? Are they targeting CIR next month? The lack of direction will really lead to less contribution. Without that,I will have a hard time convincing other friends about IV.
Have the core members given up and decreased their activity?
Core group is working hard and is commited despite lack of full support and nagative comments they get on this site or other sites. Work will go on no matter what.
Pls join your state chapter to know what we are doing and speak with us directly and get direction. You will also get updates.
In your CA state chapter there was a conference call tonight and I was invited. I joined in and only the organizer and myself were there. There was nobody else there. We both spoke for one hour and I gave update to that member because I felt that I should value a commited member who is willing to make an effort and will be willing to do the work even if it means doing it alone without help from fellow members. We request members to help themselves by helping us and we can all togeher achieve our aims.

First thing is you need to renew your passport.
Old passport will be given back.
Also if your passport is not having more than 6 months validity, US Consulate may not stamp your visa and also there could be problem with your travel. (This is my opinion)

I am on L2 since my husband is on L1. I work full time for a US employer with an EAD. Now, what would happen to my status if my husband quits his job?
What is going to be his new status? If it is not L1, then your L2 status is gone as well.

Hello,
First of all, I really appreciate your efforts to help people in their immigration issues.
Currently, I am on H4 visa. Recently, I was offered employment and got my H1B approved.
But, my new I797 approval notice does not contain I-94 part.
Do we need to apply for Change of Status from H4 to H1B now while I remain in US? Do I need to do it or my employer needs to do it?
I would really appreciate your help.

You need to go out of US, preferably to your home country, get an H1-B stamp on your passport, and reenter US using your H1-B visa stamp.

I married to a US citizen and got conditional permanent residency which is subject to be removed after 2 years. I have been a student at a university, and while an application for permanent residency I had to show/combine my income (student teaching/research assistantship) in I-864 because my spouse's income was not sufficient to sponsor me. In form I-864 instructions it says, "Intending immigrant is your spouse, his/her income can be used to combine with your income if his/her income will continue from the same source after receiving lawful permanent residency." Now, my question is that I have an offer of admission from other school, and this new school will pay me student teaching/research assistantship, can I leave my current school and join the new one? If not, how long I have to wait in order to have right to change my school?
Secondly, can my spouse leave her job and sit idle? I ask this because my spouse sponsored me in I-864, and I wonder until when she is supposed to continue her current job!
Please advise me your best to help me with my doubts. I will be obliged!

If your employer fully support you on your entry into USA after long stay in India, you are good.
You may need to show documents, letter from employer, and also he will be ready to answer phone upon entry. (they may ask him whether a job is available for you).
You can enter before your visa expiry.
Talk with company lawyer.

"home", "about" and "services" all link back to index, no content, no details about who is behind this, the examples provided in "portfolio" are not even clickable, and worst, the mail link doesn't work from index.html as it's misconfigured (emailto instead of mailto..), only from the portfolio page, but on this page, the link on the portfolio menu is wrong,
basically, you better hurry and get that site done if you're looking for jobs...

My H1B got expired in Sep 2010, ( applied for transfer before expiry), got RFE and finally approval last week, but 797 form has the validity from current date(approved date) instead of requested date in Sep 2010. So now is the period from sep 2010 to 797 approved date is considered as out of status or how it is? I have paystubs during this time and on job all the time. Any implications while going for h1b stamping in India and or at port of entry and in future GC.
Any inputs are apprciated. Thanks!
